Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Borrow Money - CashPeak mobile application (“App”) and related lending services provided by Peak Home Finance LLC, located at 8036 Benevento Dr, El Dorado Hills, CA 95762-6271 ("we", "us", or "our"). By using the App, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Acceptance of Terms

By accessing the Borrow Money - CashPeak app or using our services, you acknowledge that you have read, understood, and agree to these Terms in full.

2. Description of Services

Borrow Money - CashPeak is a loan matching platform that connects users with short-term cash advance opportunities through our lending network. You can apply for loans, receive decisions, and manage your loan application directly through the App.

3. Eligibility

To use Borrow Money - CashPeak, you must:

  • Be at least 18 years old (or the age of majority in your state)
  • Be a legal U.S. resident
  • Possess a valid Social Security Number
  • Have an active checking account at a recognized financial institution
  • Maintain a consistent source of income
  • Meet any additional eligibility requirements as determined by us

By using the App, you represent and warrant that you satisfy these criteria.

4. Account and User Responsibilities

When creating an account, you are responsible for maintaining the confidentiality of your login credentials. You agree not to:

  • Use Borrow Money - CashPeak for any unlawful or fraudulent purpose
  • Provide false or misleading information
  • Attempt to disrupt or interfere with the App’s functionality
  • Violate these Terms or any applicable laws

5. Loan Terms and Conditions

If your application is approved, you’ll receive a loan offer outlining:

  • Loan Amount: The principal offered
  • Interest & Fees: Including finance charges
  • Repayment Schedule: Payment due dates and amounts
  • Total Repayment: Full amount owed including principal and fees
  • Late Fees: Charged if payments are missed
  • Default Terms: Conditions and consequences of default

You must review and accept the loan agreement before funds are disbursed.

6. Authorization for Credit Checks

By applying for a loan via Borrow Money - CashPeak, you authorize us and our partners to obtain your credit report and related data from credit bureaus and third-party sources to assess your creditworthiness.

7. Electronic Signatures & Communications

You consent to receive all communications, including agreements and disclosures, electronically via email or within the App. You also agree to the use of electronic signatures in connection with all documents and loan agreements.

8. Intellectual Property

All content within Borrow Money - CashPeak—including text, graphics, software, and branding—is the property of Peak Home Finance LLC or its licensors. You are granted a limited, non-transferable, revocable license to use the App solely for its intended lending services.

9. Disclaimer of Warranties

Borrow Money - CashPeak and related services are provided “as is” without warranties of any kind, either express or implied. We do not guarantee uninterrupted or error-free service, nor do we guarantee loan approval.

10. Limitation of Liability

To the fullest extent permitted by law, Peak Home Finance LLC shall not be liable for any indirect, incidental, or consequential damages. Our total liability shall not exceed the amount of the loan you received (if any).

11. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of the State of California, without regard to conflict-of-law principles. All disputes shall be resolved exclusively in the state or federal courts located in El Dorado County, California, and you consent to such jurisdiction.

12. Privacy Policy

Your use of Borrow Money - CashPeak is also subject to our Privacy Policy, which explains how we collect, use, and protect your personal data. By using the App, you acknowledge and agree to the Privacy Policy.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting an updated version in the App or via email. Continued use after changes take effect constitutes acceptance of the revised Terms.
